Please read these terms carefully before using FitCore Fitness Center services. By becoming a member, you agree to be bound by these terms.
Billing
Monthly billing on your signup date. 30-day notice for cancellation.
Cancellation
Cancel anytime with 30 days notice. No cancellation fees.
Health Waiver
Medical clearance required. Assumption of risk for physical activities.
Disputes
Binding arbitration in Los Angeles County, California.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Member," "you," or "your") and FitCore Fitness Center, LLC ("FitCore," "we," "us," or "our") governing your use of our fitness facilities, services, website, and mobile applications.
By signing a membership agreement, accessing our facilities, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.
Note: We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the modified Terms. We will notify you of material changes via email or in-app notification.
2. Membership Terms
2.1 Eligibility
Membership is available to individuals who meet the following requirements:
- •Must be at least 18 years of age (16-17 with parental consent)
- •Must provide accurate and complete registration information
- •Must have medical clearance for physical exercise (see Section 6)
- •Must agree to abide by all facility rules and policies
2.2 Membership Types
FitCore offers the following membership tiers, each with specific benefits and pricing:
- •Basic Membership: Access to gym floor, cardio equipment, and basic amenities
- •Premium Membership: All Basic benefits plus group classes and extended hours
- •Elite Membership: All Premium benefits plus personal training sessions, nutrition coaching, and VIP amenities
2.3 Membership Card & Access
Your membership card or digital access credential is non-transferable and must be presented upon entry. You are responsible for all activity under your membership. Lost or stolen cards must be reported immediately; replacement fees may apply.
3. Payment & Billing
3.1 Membership Fees
Membership fees are billed on a recurring monthly or annual basis, depending on your selected plan. The billing date is the same day of each month as your initial signup date.
3.2 Payment Methods
We accept major credit cards, debit cards, and ACH bank transfers. You authorize us to charge your selected payment method for all applicable fees. You are responsible for keeping your payment information current.
3.3 Failed Payments
If a payment fails, we will attempt to process the payment again within 3 business days. After 2 failed attempts, your membership may be suspended until payment is received. A $15 late fee may apply to overdue accounts.
3.4 Price Changes
We reserve the right to modify membership prices with 30 days' advance notice. Price increases will not affect your current billing cycle. You may cancel your membership before the new price takes effect.
4. Cancellation Policy
4.1 How to Cancel
You may cancel your membership at any time through the following methods:
- •Online through your member portal at fitcore.com/account
- •In person at our front desk with valid ID
- •By email to cancellations@fitcore.com
- •By certified mail to our business address
4.2 Notice Period
A 30-day notice period is required for all cancellations. Your membership will remain active until the end of the notice period. You are responsible for any dues that accrue during this time.
4.3 Refunds
Annual membership fees are non-refundable except in the following circumstances:
- •Relocation more than 25 miles from any FitCore location (pro-rated refund)
- •Permanent disability preventing use of facilities (pro-rated refund)
- •Death of member (full refund of unused portion)
4.4 Freeze Option
Instead of cancelling, members may freeze their membership for up to 3 months per year for a reduced monthly fee of $10. Freeze requests must be submitted at least 7 days before your billing date.
5. Facility Rules
To ensure a safe and enjoyable experience for all members, please observe the following rules:
- •Proper athletic attire and closed-toe shoes required at all times
- •Wipe down equipment after each use with provided sanitizing supplies
- •Return weights and equipment to designated areas
- •Limit cardio equipment use to 30 minutes during peak hours
- •No photography or video recording without staff permission
- •Personal belongings must be stored in lockers (locks provided)
- •No food in workout areas; water bottles only
- •Children under 14 not permitted in workout areas
6. Health & Liability Waiver
IMPORTANT - PLEASE READ CAREFULLY
This section contains important provisions regarding your assumption of risk and release of liability. By using our facilities, you acknowledge understanding and acceptance of these terms.
6.1 Medical Clearance
You represent and warrant that you are physically fit and have no medical condition that would prevent you from engaging in physical exercise. If you have any health concerns, you agree to obtain medical clearance from a licensed physician before using our facilities.
6.2 Assumption of Risk
You understand and acknowledge that physical exercise involves inherent risks, including but not limited to: physical injury, heart attack, stroke, muscle strain, broken bones, and in rare cases, death. You voluntarily assume all risks associated with your use of our facilities and participation in fitness activities.
6.3 Release of Liability
To the fullest extent permitted by law, you hereby release, waive, and discharge FitCore Fitness Center, its owners, officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of or related to your use of our facilities, including claims for personal injury, property damage, or wrongful death.
6.4 Emergency Contact
You agree to provide accurate emergency contact information. In the event of a medical emergency, you authorize FitCore staff to contact emergency services and your designated emergency contact on your behalf.
7. Code of Conduct
FitCore is committed to maintaining a respectful, inclusive, and harassment-free environment. The following behaviors are strictly prohibited:
- •Harassment, intimidation, or discrimination of any kind
- •Verbal abuse or threatening behavior toward members or staff
- •Use of offensive, discriminatory, or derogatory language
- •Unsolicited physical contact or unwanted attention
- •Use of illegal substances or being under the influence
- •Unauthorized personal training or solicitation
Violations may result in immediate membership termination without refund.
8. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on our website, apps, and facilities are the property of FitCore Fitness Center or our licensors. You may not:
- •Copy, modify, or distribute our content without written permission
- •Use our trademarks for commercial purposes
- •Reproduce workout programs or training materials
9. Termination
FitCore reserves the right to suspend or terminate your membership immediately, without notice or refund, for:
- •Violation of these Terms or facility rules
- •Non-payment of membership dues after 30 days
- •Conduct that endangers staff or members
- •Fraudulent or deceptive behavior
- •Criminal activity on premises
10. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that our facilities will be uninterrupted, error-free, or completely secure. We are not responsible for any delays, failures, or interruptions in service due to circumstances beyond our reasonable control.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITCORE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN MEMBERSHIP FEES DURING THE 12 MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL FITCORE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR PERSONAL INJURY, REGARDLESS OF THE THEORY OF LIABILITY.
12. Indemnification
You agree to indemnify, defend, and hold harmless FitCore and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- •Your violation of these Terms
- •Your use of our facilities or services
- •Your violation of any third-party rights
13. Dispute Resolution
13.1 Informal Resolution
Before initiating formal dispute resolution, you agree to contact us at legal@fitcore.com to attempt to resolve any dispute informally for at least 30 days.
13.2 Binding Arbitration
Any dispute that cannot be resolved informally shall be resolved exclusively through binding arbitration administered by JAMS in Los Angeles County, California. The arbitration shall be conducted in accordance with JAMS Streamlined Arbitration Rules.
13.3 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
13.4 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any membership agreement, constitute the entire agreement between you and FitCore regarding your use of our services.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
14.4 Assignment
You may not assign or transfer these Terms or your membership without our written consent. We may assign these Terms without restriction.
